Terms of Service

1. Acceptance of Terms
By accessing or using BuyHalfCow ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform.
BuyHalfCow is a private membership network, not a marketplace or e-commerce platform. We facilitate connections between ranchers, serious buyers, and trusted partners.
2. Membership & Access
2.1 Application Process: All access requires application and approval. We reserve the right to approve or reject any application at our sole discretion.
2.2 Membership Status: Approved members gain access to certified ranchers, land deals, and brand promotions. Membership can be revoked at any time for violation of these terms.
2.3 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3. Partner Requirements
3.1 Ranchers: Must provide accurate information about ranch operations, beef types, and certifications. All ranchers are subject to verification and certification.
3.2 Brands: Must honor all promotions and discount codes provided to members. Promotions must be exclusive to BuyHalfCow members as agreed.
3.3 Land Sellers: Must provide accurate property information and maintain exclusive listing terms if agreed upon.
4. Transactions & Commissions
4.1 Payment Processing: BuyHalfCow processes deposits and certain payments on behalf of ranchers through our payment processor (Stripe). The sale contract for beef — pricing, fulfillment, and delivery — remains directly between the member and the rancher; BuyHalfCow is not a party to it.
4.2 Service Fee: BuyHalfCow’s service fee is paid by the buyer, added on top of the rancher’s price at the time of deposit, at the rate set by the rancher’s plan: free plan 10%, Pasture ($150/mo) 7%, Ranch ($350/mo) 3%, Operator ($500/mo) 0%. Ranchers keep 100% of their listed price. Ranchers who joined on the legacy referral model (before June 2026) remain governed by their original agreement, including its 10% post-close commission. Current rates are shown in the rancher billing dashboard.
4.3 Independent Relationships: BuyHalfCow acts only as a connection facilitator. We are not party to any transaction between members and partners.
5. Content & Conduct
5.1 Accuracy: All information provided must be accurate and up-to-date. Misrepresentation may result in immediate account termination.
5.2 Prohibited Conduct: Members may not use the Platform to engage in fraudulent, abusive, or illegal activities. This includes but is not limited to: harassment, spam, unauthorized data collection, or violation of any applicable laws.
5.3 Content Ownership: Partners retain ownership of content they submit but grant BuyHalfCow a license to display and distribute such content on the Platform.
6. Disclaimers & Limitation of Liability
6.1 No Warranties: The Platform is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of any content.
6.2 Third-Party Actions: We are not responsible for the actions, products, or services of ranchers, brands, or land sellers on the Platform.
6.3 Limitation of Liability: To the maximum extent permitted by law, BuyHalfCow shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Platform. To the maximum extent permitted by law, our total liability for any claim relating to the Platform is limited to the amount BuyHalfCow actually received from you in connection with the transaction giving rise to the claim.
6.4 Perishable Goods & Food Safety: Beef is a perishable product. Ranchers and their processors are responsible for handling, processing, labeling, and cold-chain storage in accordance with applicable law. Once a delivery or pickup is completed, safe storage and handling are the buyer’s responsibility. Nothing here limits any right you have under applicable consumer-protection or food-safety law.
6.5 Availability: Ranch capacity, processing dates, and delivery timing depend on the ranch and its processor. We do not guarantee that any particular ranch, cut, or date will be available.
6.6 Indemnity: You agree to indemnify and hold harmless BuyHalfCow and its officers and contractors from claims arising out of your breach of these Terms or your violation of applicable law.
6.7 Force Majeure: Neither party is liable for failure to perform caused by events beyond reasonable control, including weather, livestock disease, processor closure, carrier failure, or government action.
6.8 What this section does NOT limit: The BuyHalfCow Promise is a commitment we make voluntarily and intend to honor. Nothing in this section is intended to disclaim it. Where this section and the Promise appear to conflict about something BuyHalfCow itself committed to do, the Promise governs.
6A. Resolving a Problem
If something goes wrong, contact us first at ben@buyhalfcow.com. Most issues are resolved directly, and we would rather fix it than argue about it.
If we cannot resolve it within 30 days of you raising it, either of us may pursue the matter in the courts identified in Section 9. You are always free to raise a matter with a consumer-protection authority, and nothing here prevents that.
7. Termination
We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform immediately ceases.
8. Changes to Terms
We may modify these Terms of Service at any time. Continued use of the Platform after changes constitutes acceptance of the new terms. We will notify members of material changes via email or Platform notification.
9. Governing Law
These Terms are governed by the laws of the State of Montana, United States, without regard to its conflict-of-law provisions. BuyHalfCow operates from Kalispell, Montana. Any dispute not resolved informally will be brought in the state or federal courts located in Flathead County, Montana, and you and BuyHalfCow each consent to that venue.
